In compliance with EU regulations, last April 13, Royal Decree 235/2013 of 5 April was published in the BOE, which approves the basic procedure for the energy certification of buildings (modified by RD 564/2017, of 2 June). Thus, from 1 June 2013, the presentation or making available to buyers or tenants of the Energy Efficiency Certificate (EEC) of all or part of a building, will be required for purchase and sale or lease contracts concluded from that date.
The owner or promoter must submit, once obtained, this energy efficiency certificate to the Autonomous Community in order to proceed with its registration.
On 29 September 2016, Decree 128/2016 of 25 August 2016 regulating the energy certification of buildings in the Autonomous Community of Galicia was published in the Official Gazette of Galicia, (articles 2.2 a) and 2.2d) of this Decree were amended by the second article of Royal Decree 564/2017, of 2 June, which amends Royal Decree 235/2013. of 5 April, which approves the basic procedure for the certification of the energy efficiency of buildings) coming into force on 20 October 2016.
The entry into force of this decree on 20 October 2016, motivated the publication of the Resolution of 10 October 2016 by which the communication models for the registration of energy efficiency certificates of buildings in the Register of Energy Efficiency Certificates of Buildings of Galicia are approved.
With this new regulation, the procedures for registering the energy efficiency certificates of new buildings (IN413C) and the certificates of existing buildings (IN413D) are regulated, which must be carried out within one month from the signing of these certificates.
Both procedures will be exclusively telematic and will be carried out through a new RGEEE application that INEGA makes available to users.
From this application, the user will be able to:
a) Register the energy efficiency certificates by following the following steps:
1) Log in to the RGEEE application with username and password (the first time you will have to register and receive an email to activate the account).
2) Create and fill in your “communication” and upload the required files.
3) Confirm your communication.
4) Present. To carry out this step, it is necessary to have the digital certificate or DNIe of the communicating person or the person who acts in their representation (inthis case it will be necessary to upload to the application a power of representation according to the model).
5) Generate and pay the fee through this application.
6) Download your label.
b) Access to public consultation of certificates of buildings already registered.
c) Submit the documentation relating to the tax deduction for energy efficiency improvement works in residential buildings or single-family dwellings by submitting Annex III (from 1/1/2020).
Law 7/2019, of 23 December, on Fiscal and Administrative Measures, includes in its Title I, Chapter I, Article 1, paragraph four, a new tax deduction in the full regional quota that allows the deduction of amounts invested for the improvement of the energy rating of homes or single-family homes (read the full text here).
In order to be eligible for the tax deduction for energy efficiency improvement works in residential buildings or single-family homes, the interested party, after registering the energy efficiency certificate of the renovated building, must submit the standardized Annex III approved by the Resolution of 26 December 2019 accompanied by the following documentation:
– Report signed by a competent technician that justifies the leap achieved with the improvements, according to the model contained in the Register of Energy Efficiency Certificates of Buildings of the Autonomous Community of Galicia (download Report template).
– All invoices corresponding to the energy efficiency improvement works subject to deduction, as well as those relating to the obtaining of the energy efficiency certificate.
– Proof of payment of these invoices.
– In the event that the improvement works are carried out in a building under horizontal ownership, a certificate of the financial contributions corresponding to each municipality.
The submission of this form and the accompanying documentation may be made until the deadline for submitting the self-assessment corresponding to the tax period in which the energy improvement work subject to deduction ends, through the electronic platform of the Energy Efficiency Register of Buildings of the Autonomous Community of Galicia (RGEEE).
